Title of Goods
It is a condition of sale that all goods supplied by TDS Recon will remain the property of TDS Recon and the title of such goods shall not pass to the purchaser until they have been paid for in full.

Reconditioned Exchange Product
In order to be acceptable for exchange all old units must conform to the following specifications:-
1) Must be a complete unit (not in pieces).
2) Must be the same part number as original unit supplied.
3) Must have not suffered accidental or deliberate damage.

Surcharges
A surcharge shall be applied to the exchange product if old units are not returned at the time of sale. See a current price list for surcharge rates. Old units must be returned within 14 days of the purchase, TDS Recon withholds the right to either surcharge you retrospectively or void your warranty should the unit not  come back to us.

Warranties
The receipt of information from the purchaser and the delivery by the Company of the goods specified in any order does not in any way imply a warranty that the goods will be suitable for the purposes disclosed. The only warranty which the Company makes in connection with the proprietary good supplied. TDS Recon guarantees its reconditioned product against faulty workmanship and components for 12 months. The warranty agreement is between TDS Recon and TDS Recon's customer extending to the end user of the initial sale. If the vehicle or engine that the turbo is fitted to is subsequently sold, the warranty does not automatically pass to the new owner, to continue the warranty the seller must apply to TDS Recon for consideration to transfer the warranty terms to the new owner.

Warranty is conditional on the vehicle being properly serviced according to the vehicle manufacturers recommendations, this includes using both the correct grade and type of oil.

It is important that the failure reason and all underlying issues are resolved before refitting, TDS Recon cannot be held responsible for failures caused by external factors for example: oil starvation, oil contamination, overspeed, impact damage. These can be caused by issues such as a blocked oil feed pipe or a drop in oil pressure, particles entering the oil system, split boost pipes, damaged intercooler, worn injectors, a faulty EGR valve, blocked DPF, faulty boost control valve, hot shutdowns etc.

Warranty may be denied in the event of either the turbocharger or the engine being modified to increase power output.

In the event of any goods proving defective during the period of the warranty due to faulty material or workmanship TDS Recon shall, at its option either supply replacement goods or repair such defective goods free of charge.

Save as provided herein all representations, conditions warranties and terms, whether express or implied by common law statute or otherwise, as to the quality condition or fitness for any purpose of the goods are excluded.

Other product, supplied by TDS Recon from other manufacturers will carry the conditions of guarantee as specified by that manufacturers; available on request.

Limit of Liability
In no event shall TDS Recon be liable for any direct, indirect or consequential loss or damage of any kind howsoever caused arising out of the contract of sale or the use of the goods nor for any diminution in value of components consequent upon or resulting from the use of the TDS Recon's products. Without prejudice to any of the foregoing, the liability arising out of or connected with any order, or manufacture, sale, delivery, resale or use of any goods covered by any such order including but not limited to, loss or liability arising from breach of contract, shall in no case exceed the unit price of such goods or parts thereof involved in the claim. The limit of liability shall not apply to any claim for death or personal injury resulting from the negligence of the Company.
 
Turbochargers for competition use
Turbochargers used for any form of racing are supplied in good faith and on the understanding that no guarantee is given in respect of performance or reliability of the product, either by the manufacturers or TDS Recon.

TDS Recon cannot be held responsible for personal injury or damage caused to the engine or vehicle by a failed turbo.
